Terms & Conditions

1. This prize draw is open to all UK residents except employees of the Promoter, their families or any third party directly associated with the administration of the prize draw. Parents or guardians may enter on a child’s behalf and for those entrants under the age of 16, you must obtain written parental or guardian consent to enter and claim your prize.
2. The prize draw is free to enter, and no purchase is necessary however internet access is required in order to enter the prize draw via https://www.thetoyshop.com/spiderverse-prize-draw
3. To enter, simply, visit https://www.thetoyshop.com/spiderverse-prize-draw and complete the entry form.
4. The opening date for entries is 25th May 2023. The closing date for entries is 23.59 on 21st June 2023. Entries received after this time will not be valid.
5. The Promoter accepts no responsibility for entries not successfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind.
6. There is 1 prize to be won. The winner will be chosen by random draw performed by a computer process on 27th June 2023 ("Draw Date").

7. The winner will receive a family trip for 2 adults and 2 children (the “Recipients”) to New York City including:

   • Round trip economy/coach flights (inclusive of all applicable airport taxes, fees, and duties including standard baggage and return airport transfers in New York City) from the winner’s choice of London, Edinburgh, Belfast or Cardiff to New York City, New York, USA. Flights may be indirect and not all routing will be available, flight itinerary will be selected by the prize provider at their sole discretion;

   • Accommodations in one quadruple occupancy room for two adults and two children under 16; Trip must include a Saturday night stay. Accommodation does not include any other meals, incidentals, gratuities, telephone calls, or any other personal expenses incurred during the trip, these will be the responsibility of the Recipients; A credit card for incidentals may be requested by the hotel at check-in and therefore at least one of the Recipients must possess and travel with a valid credit card; Accommodations will be selected by Element London Ltd at their sole discretion;

   • A 1 hour Private Parkour Masterclass which will be tailored to participant’s ability;

   • A Virtual Reality Experience consisting of a 2 hour pass to top virtual reality arcade. Please note, the maximum weight limited for all machines at the VR experience is 250lbs/113kg;

   • A 2 hour Private Graffiti And Street Art Tour of Brooklyn with a private guide.

   • Tickets to Immersive Exhibition Space in an NYC Skyscraper

   • All tours and experiences will be conducted in English;

   • Prize Package is for up to two adults and two children under 16, all of whom must travel at the same time with the same itinerary; At least one traveller must be aged 21 or over; Where any travellers are aged under 18, they must have prior parental or guardian permission;

   • Prize is valid for 12 months from the date of notification and all travel must be completed within that time;

   • Winners must contact the prize provider with three preferred travel dates in three separate months no later than six weeks prior to departure;

   • Once booked no changes to the itinerary will be permitted;

   • Prize cannot be taken over Christmas, New Year or Public Holidays in the prize package destination or the country of departure;

   • All recipients are responsible for obtaining any other documentation required for travel to and entry to the prize package destination; All travellers will require a passport valid for at least 6 months on the date of travel; any necessary visas or insurance are the responsibility of the winner and guests;

   • The prize excludes domestic ground transfers, meals and drinks, excursions, attractions, treatments, visas, personal expenses and anything not expressly stated in the prize package;

   • Prize is non-refundable and non-transferable; No cash alternative is available;

   • The prize package inclusions are subject to availability, where any of the stated inclusions are unavailable, Element London Ltd will offer suitable alternatives of equal value; Minimum age, weight, size and height restrictions as well as medical warnings may apply and will vary by activity. These will be advised to the winners in advance of the booking. If a winner is unable to participate in any of the stated activities due to the restrictions or medical warnings, then Element London Ltd will offer suitable alternatives of equal value, alternative activities will be determined by prize provider at their sole discretion;

   • If winner chooses to forfeit any activities (other than as a result of the applicable restrictions set out above) then no alternatives will be provided;

   • Prize must be taken in accordance with government guidelines and COVID-19 rules and restrictions;

   • The Prize Provider is Element London Ltd. Any personal data submitted by the winner to the Prize Provider will be treated in accordance with Prize Provider’s privacy policy, which is accessible at: https://elementlondon.com/element-london-privacy-policy-travel-english

8. The winner will be contacted via the details provided at the time of entry. If a winner does not respond to the Promoter within 7 days of being notified by the Promoter that they have won, then the winner's prize will be forfeited, and the Promoter will be entitled to select another winner in accordance with the process described above.
9. The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Promoter's control make it necessary to do so.
10. The decision of the Promoter regarding any aspect of the prize draw is final and binding and no correspondence will be entered into about it.
11. The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will send the surname and county of major prize winners to anyone who emails PlayIsNeverCancelled@theentertainer.com (subject Spiderman) or writes to Spiderman, The Entertainer, TEAL House, Anglo Office Park, 67 White Lion Road, Amersham, Bucks HP7 9FB (enclosing a self-addressed envelope) within one month after the closing date stated in condition 4. If you object to any or all of your surname and county, being published or made available, please contact the Promoter by emailing PlayIsNeverCancelled@theentertainer.com. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.
12. Participants are deemed to have accepted and agreed to be bound by these terms and conditions upon entry. The Promoter reserves the right to refuse entry or refuse to award the prize to anyone in breach of these terms and conditions.
13. The Promoter reserves the right to hold void, cancel, suspend, or amend the promotion where it becomes necessary to do so.
14. Personal data supplied during the course of this promotion will only be processed as set out in the Promoter's privacy policy here https://www.thetoyshop.com/privacy. See also condition 11 with regard to the announcement of winners.
15. The prize draw will be governed by English law and entrants to the prize draw submit to the jurisdiction of the English courts.
